The Commission's Review Board currently reviews Initial Decisions of Administrative Law Judges and other related hearing matters. Given the small number of pend­ ing and anticipated hearing cases and critical budgetary considerations, the Commission has concluded that the proper dispatch of its business and the public interest will best be served by eliminating the Review Board, effective March 29, 1996. Any matters which remain pending before the Review Board on March 29, 1996 will be certified to the Commission for action. To ensure an orderly transi­ tion, exceptions and other pleadings due to be filed with th,e Review Board in new cases after March 1, 1996, shall be directed to the Commission and not the Board. The Managing Director is delegated authority promptly to make conforming rule changes. 2. Authority for the adoption of the foregoing revisions is contained in Section 4(f)(l), 4(i), 4(j), S(b), S(c), and 303(r) of the Communications Act of 1934, as amended. 47 U.S.C. §§ 154(f)(l), 154(i), 154(j), 155(b), and 303(r). 3. Because this action involves rules of agency organiza­ tion, the notice and comment provision of the Administra­ tive Procedure Act, 5 U.S.C. 553(b) , is inapplicable. 4. ACCORDINGLY, IT IS ORDERED that effective March 29, 1996 the Review Board IS ELIMINATED. 5. IT IS FURTHER ORDERED that the Managing Di­ rector IS DELEGATED authority promptly to make revi­ sions to the Commission's Rules and its Organizational Manual.
