In October 1995, the Commission initiated a rulemaking proceeding in CC Docket No. 95-155 in re­ sponse to industry reports that the existing pool of toll free numbers was being consumed at a rate that would exhaust the 800 Service Access Code ("SAC") in the near future, and that an additional SAC ("888") was needed to provide immediate relief. 1 The industry anticipates that it wil.l be able to open the 888 code on March I, 1996 for toll free calling nationwide. Resolution of at least some issues ad­ dressed in that N PRM is essential to enable the industry to open the 888 SAC for toll free dialing on that date. In light of the recent Federal government furlough and subsequent emergency snow days, we conclude that the most efficient way to ensure that regulatory decisions necessary for the March l, 1996 deployment of 888 are made is to delegate authority to the Chief, Common Carrier Bureau to resolve those issues upon which the industry depends for its sched­ uled deployment of 888. 2. Accordingly, IT IS ORDERED. pursuant to Section 5(c)(l) of the Communications Act, 47 U.S.C. § 155(c)(l), and Section 0.20l(d) of the Commission's rules, 47 C.F.R. § 0.20l (d), that authority be delegated to the Chief, Com­ mon Carrier Bureau to resolve those issues raised in the NPRM upon which the industry's ability to deploy 888 on its projected schedule depends.
