This is a Notice of Violation ("Notice") issued pursuant to Section 1.89 of the Commission’s Rules,1 to, Entercom Sacramento License, LLC, licensee of radio station KBZC, 106.5 MHz, Sacramento, California. 2. On October 27, 28, 29, 30, and November 12, 2009, agents of the Enforcement Bureau’s San Francisco Office monitored radio station KBZC located in Sacramento, California, and observed the following violations: a. 47 C.F.R. § 73.1201(a): “When regularly required. Broadcast station identification announcements shall be made: (1) At the beginning and ending of each time of operation, and (2) Hourly, as close to the hour as feasible, at a natural break in program offerings.” On the dates listed above, monitoring by San Francisco agents revealed that KBZC either failed to give broadcast station identification announcements, or failed to give such announcements as close to the hour as feasible, at a natural break in program offerings. b. 47 C.F.R. § 73.1201(b)(1): “Content. Official station identification shall consist of the station’s call letters immediately followed by the community or communities specified in its license as the station’s location; Provided, That the name of the licensee, the station’s frequency, the station’s channel number, as stated on the station’s license, and/or the stations affiliation may be inserted between the call letters and station location.” On the dates listed above, monitoring by the San Francisco agents revealed that the station identification given by KBZC failed to include all the required information, 1 47 C.F.R. § 1.89. Federal Communications Commission 2 including the call letters as well as the community specified in the station’s license. 3. Pursuant to Section 308(b) of the Communications Act of 1934, as amended,2 and Section 1.89 of the Commission's Rules, Entercom Sacramento License, LLC , must submit a written statement concerning this matter within 20 days of release of this Notice. The response must fully explain each violation, must contain a statement of the specific action(s) taken to correct each violation and preclude recurrence, and should include a time line for completion of pending corrective action(s). The response must be complete in itself and signed by a principal or officer of the licensee.
