OFFICE OF THE CHAIRMAN FEDERAL COMMUNICATIONS COMMISSION WASHINGTON Novanber 20, 2009 The Honorable Rodney P. Frelinghuysen u.s. House of Representatives 2442 Rayburn House Office Building Washington D.C. 20515 Dear Congressman Frelinghuysen: Thank you for your letter on behalf of Morris County, New Jersey, regarding the County's application for authority to operate a public safety paging facility on frequency 476.2875 MHz. Because the Commission has allocated this frequency for commercial use, the County submitted a waiver request with its application to enable it to use the frequency for public safety purposes. I am pleased to inform you that the Commission's Public Safety and Homeland Security Bureau released an Order on October 8,2009, granting the applications and waiver request. In reaching this decision, the Bureau determined that grant of the waiver will provide the County with access to additional UHF spectrum in order to promote effective public safety communications without compromising radio operations of other licensees. I am enclosing a copy of that Order for your information. I appreciate your bringing this important matter to my attention. Please let me know if you have any further questions. Julius Genachowski Chairman Enclosure
