This is an Official Citation issued pursuant to Section 503(b)(5) of the Communications Act of 1934, as amended ("Act"),1 to Telos Online ("Telos") for violation of Part 15.5(b) of the Communication's Rules.2 2. In response to complaints of intermittent interference to Global Positioning System ("GPS") reception devices operating on the rooftop of 1670 Broadway Street in Denver, Colorado, the Enforcement Bureau's Denver District Office conducted an on-scene investigation. The investigation revealed that on May 11, 2009, equipment owned and operated by Telos, co- located atop the rooftop penthouse of 1670 Broadway, was radiating emissions on 1575 MHz. Multiple Telos' tranceivers, specifically Tranzeo Wireless Technologies, Inc., brand assigned FCC ID: QRF-58QGFKN2U to operate in the 5250-5350 MHz and 5725-5850 MHz frequency bands, were identified as the sources of interference. 3. Section 15.5(b) states "operation of an intentional, unintentional, or incidental radiator is subject to the condition that no harmful interference is caused…" The operation of the transmitters caused interference to GPS receivers utilized by the City of Denver, Colorado, including the Police Department, to control their 800 MHz trunked radio system. 4. Violations of the Act or the Commission's Rules may subject the violator to substantial monetary forfeitures,3 seizure of equipment through in rem forfeiture action, and criminal sanctions, including imprisonment.4 5.
