In the petition filed on October 11, 2011, Lockheed Martin Corporation requested that the Commission amend Part 15 of its rules to enable more flexible use of radio frequency identification (RFID) system in the 433 MHz band. We have noted in the press that Lockheed Martin Corporation sold its RFID business in 2012 (see http://www.rfidjournal.com/articles/view?9944), and more recently, by letter of May 6, 2014 you have requested the petition be withdrawn and the proceeding terminated without prejudice. We note that comments were filed both in support of and in opposition to the petition. However, we do not find sufficient basis to propose rules based on these filings. Accordingly, we find that the original petition does not warrant consideration by the Commission and that it is appropriate to dismiss the petition and close the record in this proceeding. Any party interested in pursuing changes to the rules for RFID operations in the 433 MHz band may file a new petition. Accordingly, pursuant to the authority delegated in Section 0.241(e) of the Commission's rules, 47 C.F.R. §0.241(e), the Petition for Rulemaking filed by Lockheed Martin Corporation on Oct. 11, 2011is dismissed without prejudice and this proceeding, RM-11651, is terminated.
