File No. 1134 Comments Due: December 19, 2013 Section 214 Application Applicant: AT&T Services Inc. on behalf of The Southern New England Telephone Company d/b/a AT&T Connecticut On December 3, 2013, AT&T Services Inc. (AT&T or Applicant) filed an application with the Federal Communications Commission (FCC or Commission) on behalf of its affiliate, The Southern New England Telephone Company d/b/a AT&T Connecticut (SNET or Applicant), located at 101 N. 13th Street, Floor 1, Fort Smith, AR 72901, requesting authority, under section 214 of the Communications Act of 1934, as amended, 47 U.S.C. § 214, and section 63.71 of the Commission’s rules, 47 C.F.R. § 63.71, to discontinue a certain domestic telecommunications service throughout SNET’s service territory in Connecticut (Service Area).1 AT&T indicates that SNET currently offers SNET SONET Network service (SSNS) in the Service Area. AT&T explains that SSNS provides dedicated transport utilizing Synchronous Optical Network (SONET) transmission standards, with network elements provided between two customer premises or between a customer’s premises and an SNET Central Office Node. AT&T specifies that SSNS provides point-to-point high capacity optical network capabilities to customers requiring network facilities at OC3/OC3c (155.52 Mbps) and OC12 (622.08 Mbps) levels. AT&T asserts, however, that SNET does not have any current customers subscribing to this service and that it plans to discontinue offering SSNS in the Service Area on or after January 6, 2014, subject to Commission authorization. AT&T maintains that the public convenience and necessity will not be impaired by the proposed discontinuance because it currently provides dedicated point-to-point OC-3 and OC-12 services via its OC-N product family. According to AT&T, SNET offers SSNS pursuant to non-dominant carrier regulation. In accordance with section 63.71(c) of the Commission’s rules, AT&T’s application will be deemed to be granted automatically on the 31st day after the release date of this public notice, unless the Commission notifies AT&T that the grant will not be automatically effective. In the application, AT&T indicates that SNET plans to discontinue offering SSNS in the Service Area on or after January 6, 2014, 1 AT&T asserts that it does not believe that approval is required, but states that it is filing out of an abundance of caution to ensure compliance with the Commission’s rules. 2subject to Commission authorization. Accordingly, pursuant to section 63.71(c) and the terms of the application, absent further Commission action, SNET may discontinue offering SSNS in the Service Area on or after January 6, 2014. The Commission normally will authorize proposed discontinuances of service unless it is shown that customers or other end users would be unable to receive service or a reasonable substitute from another carrier, or that the public convenience and necessity would be otherwise adversely affected. Comments objecting to this application must be filed with the Commission on or before December 19, 2013. Such comments should refer to WC Docket No. 13-297 and Comp. Pol. File No. 1134. Comments should include specific information about the impact of this proposed discontinuance on the commenter, including any inability to acquire reasonable substitute service. Comments may be filed using the Commission’s Electronic Comment Filing System (ECFS) or by filing paper copies. See Electronic Filing of Documents in Rulemaking Proceedings, 63 FR 24121 (1998).
