(collectively, the Section 271 Coalition) filed a petition with the Federal Communications Commission (Commission) for expedited rulemaking seeking adoption of rules to govern the provision of certain network elements by Bell Operating Companies (BOCs) pursuant to section 271(c)(2)(B) of the Communications Act of 1934, as amended (Act).1 The Section 271 Coalition asserts that facilities-based competitors continue to rely, in many locations, on BOC loops and transport facilities to reach end users and aggregation locations. The Section 271 Coalition states that access to these facilities, pursuant to the section 271(c)(2)(B) competitive checklist, is therefore “essential to enable narrowband and broadband competition.”2 Accordingly, the Section 271 Coalition proposes specific rules to govern the provision of elements by the BOCs, as required by the section 271 checklist, that it claims “would establish clear requirements describing what constitutes each individual Checklist item, as well as to give effect to the just and reasonable rate standard that the Commission has previously determined applies to the Checklist Elements.”3 The Coalition requests that the Commission adopt its proposed rules on an expedited basis.4 This matter shall be treated as a “permit-but-disclose” proceeding in accordance with the Commission's ex parte rules. See 47 C.F.R. §§ 1.1200, 1.1206.
