Federal Communications Commission DA 09-1543 Before the Federal Communications Commission Washington, D.C. 20554 ) In the Matter of ) ) Amendment of Section 73.622(i), ) MB Docket No. 09-125 Final DTV Table of Allotments, ) RM-11548 Television Broadcast Stations. ) (Biloxi, Mississippi) ) NOTICE OF PROPOSED RULEMAKING Adopted: July 14, 2009 Released: July 16, 2009 Comment Date: [15 days after date of publication in the Federal Register] Reply Comment Date: [25 days after date of publication in the Federal Register] By the Chief, Video Division, Media Bureau: 1. The Commission has before it a petition for rulemaking filed by WLOX License Subsidiary, LLC (“WLOX”), the permittee of station WLOX(TV), digital channel 13, Biloxi, Mississippi.1 WLOX requests the substitution of its pre-transition digital channel 39 for its allotted post-transition channel 13 at Biloxi. 2. WLOX states that when it discontinued its pre-transition channel 39 digital service on June 12, 2009, “a significant number of WLOX’s viewers complained of a sudden inability to receive the Station’s digital signal [on channel 13], particularly through antennas located indoors.”2 WLOX also states that many area viewers depend upon battery-powered receivers in order to obtain emergency information during hurricanes, and that it has learned that “battery-powered DTV receivers – even those located close to Biloxi – have been unable to receive the Station’s channel 13 signal consistently.”3 The Commission recently granted WLOX Special Temporary Authority to resume operation on channel 39,4 and according to WLOX, it has since experienced a significant reduction in reception-related complaints from viewers and has also determined that users of portable DTV receivers generally are able to receive channel 39 without difficulty. 3. We believe that WLOX’s proposal warrants consideration. DTV channel 39 can be substituted for DTV channel 13 at Biloxi, Mississippi, as proposed, in compliance with the principal community coverage requirements of Section 73.625(a) of the Commission’s rules,5 at coordinates 30-43-22 N. and 89-05-28 W. In addition, we find that this channel change meets the technical requirements set forth in Sections 73.616 and 73.623 of the Commission’s rules.6 We propose to substitute DTV channel 39 for 1 WLOX has filed an application to license the construction of its channel 13 digital facilities. Because the Commission has not yet lifted its freeze on the filing of petitions for rulemaking to establish new DTV channel allotments and for changes in community of license,10 we will not consider counterproposals which propose new allotments or changes in community of license. (b) With respect to petitions for rule making which conflict with the proposal in this Notice, they will be considered as comments in the proceeding, and Public Notice to this effect will be given as long as they are filed before the date for filing initial comments herein. If they are filed later than that, they will not be considered in connection with the decision in this docket. (c) The filing of a counterproposal may lead the Commission to allot a different channel than was requested for any of the communities involved. 4. Comments and Reply Comments; service.
