Federal Communications Commission Washington, D.C. 20554 May 5, 2009 DA 09-1010 Alan S. Tilles, Esq. Shulman Rogers Gandal Pordy & Ecker, P.A 11921 Rockville Pike, Third Floor Rockville, MD 20852 Re: Petition for Reconsideration of Dismissal of Application FCC File No. 0003463003 Dear Mr. Tilles: This letter dismisses as moot the petition you filed on March 26, 2009 on behalf of Northwest Airlines, Inc. (Northwest) for reconsideration of the dismissal of the above-referenced application. The petition argues that the dismissal was erroneous because the application sought only to add to Northwest’s license for Station WNAY544 a frequency pair for which Northwest already was licensed for the same location and technical parameters under Call Sign WPYD855. When I informed you that the application actually requested a higher effective radiated power (ERP) than is authorized to Station WPYD855, your firm responded that this was inadvertent, and that Northwest would file a new application for the correct ERP. On April 7, 2009, Northwest filed an application, FCC File No. 0003798489, to add the frequency pair to the license for Station WNAY544 with the same ERP as is authorized to Station WPYD855. Consequently, we conclude that Northwest’s petition for reconsideration of the dismissal of application FCC File No. 0003463003 is moot. We therefore dismiss, pursuant to Sections 4(i), 303(r), and 405 of the Communications Act of 1934, as amended, 47 U.S.C. §§ 154(i), 303(r), 405, and Section 0.331 of the Commission’s Rules, 47 C.F.R. § 0.331, the petition for reconsideration filed by Northwest Airlines, Inc. on March 26, 2009, as moot.
