C. 20554 Internet: http:// www. fcc. gov ftp. fcc. gov DA 00- 1175 May 26, 2000 Low Power FM Filing Window Instructions FCC Makes Available Electronic Filing for the May 30, 2000 – June 5, 2000 Window for Low Power FM New Station Construction Permit Applications The Mass Media Bureau issues this Public Notice to announce that low power FM (LPFM) new station construction permit applications (Form 318) may be filed electronically during the May 30, 2000 – June 5, 2000 LPFM window. This Notice also provides additional guidance on filing procedures for LPFM stations located in the jurisdictions included in the upcoming window: Alaska, California, District of Columbia, Georgia, Indiana, Louisiana, Maine, Mariana Islands, Maryland, Oklahoma, Rhode Island, and Utah. Electronic Filing: Applicants may file Form 318 electronically. Paper and electronically filed applications will receive identical processing. However, the Commission encourages applicants to use the electronic filing system. Each applicant filing electronically will benefit from “error checks” in the Form 318 computer software program and obtain immediate confirmation of the receipt of its application by the Commission. In addition, electronic filing will expedite the Commission’s application review process. Applicants filing electronically also are encouraged to file as early in the window as possible. As is the case with paper filings, electronically filed applications will not be made publicly available until after the close of the window. Moreover, electronically filed applications may be accessed and amended at any point prior to the close of the window through the electronic filing system described in more detail below. 1 2 Electronic filing is available through the broadcast station Consolidated Database System (CDBS) online electronic forms filing system. Users can access this system via the Internet from the Mass Media Bureau’s web site at: http:// www. fcc. gov/ mmb Electronic filing system instructions are available in the CDBS User’s Guide. The Guide can be accessed from the Mass Media Bureau web site, above, by clicking on the “CDBS” link. This action will take the user to the Mass Media Bureau CDBS Electronic Filing System site. The user should then click on the “Go to CDBS User’s Guide” link. Internet access to the CDBS online electronic forms filing system requires, at a minimum, a browser such as Netscape version 3.04 or Internet Explorer version 3.51. The Commission must receive electronically filed applications no later than 11: 59 PM EDT on June 5, 2000. Paper Filing: Form 318 may be downloaded from the Internet at: http:// www. fcc. gov/ formpage. html Forms also may be obtained by mail or facsimile by calling (202) 418- FORM. Detailed instructions on paper filing procedures are contained in Public Notice, Low Power FM Filing Window, DA 00- 914 (released April 28, 2000). A copy of this Public Notice may be found by clicking on the “April 28, 2000 LPFM Public Notice” link at the main LPFM web page: http:// www. fcc. gov/ mmb/ asd/ lpfm/ index. html Timing and Scope: Applications must specify LP 100 station facilities with transmitter sites located within the jurisdictions included in this filing window. Applications must be filed during the window. Applications not complying with these requirements or which are incomplete or patently defective will be dismissed or returned. Single Application Limitation: An applicant may not file more than one application in this window. Currently, no one may hold an attributable interest in more than one LPFM station. Section 73.855( b)( 1). Accordingly, a second application filed by an applicant in this window would be treated as a “conflicting” application subject to dismissal under Section 73.3518. See also Section 73.801 (making Section 73.3518 applicable to LPFM stations). This restriction applies even where more than one frequency is available to an applicant at its proposed transmitter site.
